1. INTRODUCTION

Welcome to Type Keeper.

Type Keeper is software designed and developed by pXdWorks, with Viliyan Vasilev as its developer, and is provided through the Type Keeper Android application, browser extension, website and related services (collectively called "Service").

These Terms of Service and Privacy Policy (collectively called "Agreements") govern your access to and use of the Service and explain how information may be processed in connection with your use of Type Keeper.

By installing, accessing, subscribing to, or otherwise using Type Keeper, you acknowledge that you have read, understood and agreed to these Agreements.

If you do not agree with these Agreements, you must not install, access or use the Service!

2. DEFINITIONS

For purposes of these Agreements:

“Type Keeper”, “Service”, “Software”, “Application” or “Extension” means the Type Keeper Android application, browser extension, website, updates, features and associated functionality.

“Developer”, “we”, “us” or “our” means the person or entity legally responsible for providing the Service, including Viliyan Vasilev / pXdWorks, as applicable to the relevant distribution channel.

“User”, “you” or “your” means any person accessing or using the Service.

“User Data” means information created, entered, retained or otherwise handled by you through the Service.

“Subscription” means a paid plan granting access to paid or premium functionality.

“Third-Party Service” means any external service, platform, SDK, payment processor, analytics provider, advertising provider, hosting provider or application marketplace used in connection with the Service.

3. ACCEPTANCE AND ELIGIBILITY

By using the Service, you represent that:

• you have the legal capacity to enter into these Agreements;

• you are legally entitled to use the device and account on which Type Keeper is installed;

• your use of the Service complies with applicable laws;

• information you provide to us is accurate;

• you will not use the Service for unlawful, fraudulent or harmful purposes.

The Service is intended for users aged 13 or older, or such higher minimum age as may be required by the laws applicable to you.

Where local law requires parental or guardian consent, you must obtain such consent before using the Service.

4. ABOUT TYPE KEEPER

Type Keeper is an advanced text-input and clipboard-history retention utility.

The Service may allow you to retain, manage, reuse and organize text that you have entered or copied on your device.

Certain functionality may require an active Internet connection.

Some functionality may operate entirely or substantially on your device.

We continuously seek to maintain and improve the Service, but software, operating systems, browsers and third-party platforms may change over time.

Accordingly, we reserve the right to modify, update, suspend, replace, restrict or discontinue features of the Service.

5. LOCAL DATA AND PRIVACY-FIRST DESIGN

Type Keeper is designed with a local-processing and data-minimization approach.

Where technically possible, text and clipboard information required for the core functionality of Type Keeper is processed and retained locally on your device rather than transmitted to our servers.

IMPORTANT

Type Keeper is not a password manager.

Type Keeper is designed not to save text inputs originating from password-type fields and does not intentionally retain password-field contents as part of its normal operation.

However, no software can provide an absolute guarantee against every possible interaction between an application, operating system, browser, keyboard, third-party application, malicious software or compromised device.

You should therefore never intentionally use Type Keeper as a password-storage system.

6. LOCAL STORAGE

Depending on the platform and version:

Android

Information retained by the Android application may be stored in the application's local device storage.

The security characteristics of local storage depend on the Android operating system, device configuration, permissions, manufacturer implementation and other software installed on the device.

If the device is rooted, modified, jailbroken, compromised or otherwise operating outside its intended security model, locally stored information may become accessible to unauthorized software.

Browser Extension

Information retained by the browser extension may be stored using browser-local storage mechanisms and may be protected using available application/browser security mechanisms.

You are responsible for securing your device!

7. DEVICE SECURITY

You agree to take reasonable steps to protect your device and locally stored information.

This includes:

• maintaining a secure device lock;

• installing operating-system security updates;

• installing Type Keeper only from trusted distribution channels;

• avoiding unauthorized or modified versions of Type Keeper;

• avoiding rooted or jailbroken devices where this may compromise security;

• protecting your Google, browser and other relevant accounts;

• preventing unauthorized physical or remote access to your device.

We are not responsible for security incidents caused by a compromised device, operating system, browser, account, malware or third-party software.

8. INFORMATION WE COLLECT

We apply data minimization and seek to collect only information reasonably necessary to provide, maintain, secure and improve the Service.

Depending on how you use Type Keeper, information processed by us or our service providers may include:

Account information

• email address;

• account identifier;

• authentication information;

• basic account information provided by an authentication provider.

Purchase information

Depending on the purchase method:

• transaction identifier;

• subscription identifier;

• product or plan;

• purchase date;

• billing status;

• receipt information.

Payment-card credentials are generally processed by the applicable payment provider rather than stored directly by us.

Technical information

We or our service providers may process limited technical information such as:

• IP address;

• device type;

• operating-system version;

• browser information;

• application version;

• timestamps;

• crash reports;

• diagnostic information;

• error information;

• aggregated technical statistics.

9. WHAT WE DO NOT INTENTIONALLY COLLECT

We do not collect or store your:

• text input contents;

• clipboard history contents.

Core Type Keeper text-retention functionality is intended to remain local to the device.

We do not access or sell your private Type Keeper text input or clipboard history contents to advertisers.

10. SENSITIVE PERMISSIONS

Certain Type Keeper functionality may require sensitive Android, browser or operating-system permissions.

Such permissions are requested solely to enable the relevant functionality of the Service.

Examples may include permissions required to:

• interact with text input;

• access clipboard functionality;

• operate the application or extension;

• provide functionality across supported applications or websites; or

• maintain required background functionality.

Permissions are subject to the applicable operating system and platform policies.

Where a permission allows Type Keeper to technically access information on your device, such technical access does not by itself mean that the information is transmitted to us.

Where the applicable functionality processes information locally, that information remains on your device.

You may revoke permissions through the applicable device or browser settings, although doing so may disable some or all functionality.

11. DATA PROCESSING PURPOSES

Information that we legitimately process may be used for:

• providing the Service;

• authenticating users;

• managing subscriptions;

• processing purchases;

• providing customer support;

• preventing fraud and abuse;

• diagnosing technical problems;

• maintaining security;

• improving reliability;

• measuring aggregate Service performance;

• complying with legal obligations;

• protecting our legal rights.

We do not use your private Type Keeper text input or clipboard history for unrelated profiling purposes.

12. LEGAL BASIS FOR PROCESSING

Where the GDPR or similar legislation applies, personal information may be processed on the following legal bases:

Contract

Where processing is necessary to provide the Service or fulfill an agreement with you.

Legitimate Interests

Where processing is necessary for security, fraud prevention, diagnostics, Service improvement or protection of legal rights, provided those interests are not overridden by applicable rights.

Consent

Where consent is legally required, including certain advertising, tracking or permission-based functionality.

Legal Obligation

Where processing is necessary to comply with applicable law.

Where processing is based on consent, you may withdraw that consent subject to applicable law.

13. THIRD-PARTY SERVICES

Type Keeper may use third-party services necessary for distribution, payments, analytics, diagnostics, advertising, authentication, infrastructure or other operational functions.

Depending on the current implementation, these may include:

• Google Play Services;

• Google Ads;

• Google AdSense;

• Google AdMob;

• Google Analytics;

• Firebase;

• Firebase Crashlytics;

• Firebase Firestore;

• MongoDB / Realm or their alternatives;

• Stripe;

• application marketplace or browser-store services.

Third-party providers may independently process certain information under their own terms and privacy policies.

We do not control the independent privacy practices of third parties.

14. GOOGLE PLAY

Android purchases may be processed through Google Play Billing.

Google may process payment information through your Google Account and its own payment infrastructure.

We do not require or intentionally store your complete payment-card information for transactions processed through Google Play.

Your use of Google Play is also subject to Google's applicable terms and policies.

15. STRIPE AND OTHER PAYMENT PROCESSORS

Browser extension or web purchases may be processed through Stripe or another authorized payment provider.

Payment providers may collect and process payment information necessary to complete transactions.

We do not intentionally store complete payment-card numbers, CVV codes or similar sensitive payment credentials when those credentials are handled directly by the payment provider.

16. SUBSCRIPTIONS

Certain Type Keeper features may be offered through paid subscriptions.

Before completing a purchase, the applicable price, billing period and features will be presented to you.

Unless otherwise stated, subscriptions may automatically renew at the end of each billing period until cancelled.

The applicable billing provider may charge the payment method associated with your purchase.

Cancelling a subscription generally stops future renewal but does not necessarily terminate benefits that have already been paid for.

You will normally retain access to paid features until the end of the already-paid billing period, subject to the applicable purchase terms.

Deleting the Type Keeper application does not necessarily cancel a subscription.

Subscriptions purchased through Google Play must generally be cancelled through Google Play.

Subscriptions purchased through another provider must generally be cancelled through that provider.

17. REFUNDS

We may provide refunds in accordance with the applicable purchase channel and applicable law.

For eligible purchases made directly through an applicable payment provider, you may contact:

We are able to issue manual refunds within 14 days of the original purchase of the contract.

If you want to cancel, reschedule or want a refund on any experiences or activities, you can do so without any additional charge within 14 days prior to the start time of the event. No refunds will be issued after that term.

For purchases made through Google Play or another application marketplace, refund requests may be governed by the marketplace's refund process and applicable consumer law.

Nothing in these Agreements removes or limits mandatory statutory consumer rights.

Any voluntary refund policy offered by us is additional to those rights.

18. CONSUMER RIGHTS

If you are a consumer, particularly within the European Union or European Economic Area, nothing in these Agreements is intended to exclude, restrict or waive mandatory rights granted to you by applicable consumer-protection legislation.

Where applicable law grants you rights relating to cancellation, withdrawal, refunds, conformity, digital content or digital services, those rights remain unaffected.

19. ADVERTISING

Free versions or certain features of Type Keeper may display advertisements.

Advertisements may be delivered through third-party advertising SDKs.

Advertising providers may process technical identifiers, device information, approximate location, advertising identifiers or other information according to their own policies and applicable law.

Where required, appropriate consent mechanisms will be presented.

Users located in jurisdictions requiring advertising/privacy choices may be able to modify those choices through the Service or applicable device settings.

We do not intentionally provide your Type Keeper text input or clipboard history data to advertisers.

20. EMAIL COMMUNICATIONS

We may send transactional communications reasonably necessary for the Service, including:

• purchase confirmations;

• account notifications;

• security notifications;

• support responses;

• subscription information;

• important changes to the Service or Agreements.

Where legally permitted, we may also send promotional communications.

You may unsubscribe from marketing communications through the available unsubscribe mechanism or by contacting:

Transactional and legally required communications may continue after marketing opt-out.

21. COOKIES AND WEBSITE TECHNOLOGIES

The Type Keeper website may use cookies or similar technologies.

These technologies may be used for:

• website functionality;

• security;

• analytics;

• performance measurement;

• remembering preferences;

• aggregate statistics.

Where required by law, non-essential cookies will be subject to the applicable consent mechanism.

You may also control cookies through your browser settings.

22. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the purposes described in these Agreements or as required by law.

Retention periods may depend on:

• the nature of the information;

• the purpose for which it was collected;

• legal requirements;

• accounting obligations;

• fraud prevention;

• security requirements;

• dispute resolution.

Where information is no longer necessary, we may delete, anonymize or otherwise de-identify it.

23. ACCOUNT DELETION

You may request deletion of your account and associated personal information by filling the form located at https://www.type-keeper.com/request-account-deletion.

Account deletion may result in permanent loss of account-related information and cannot necessarily be reversed.

We may retain limited information where necessary to:

• comply with legal obligations;

• prevent fraud;

• establish or defend legal claims;

• maintain security;

• resolve disputes;

• satisfy accounting or regulatory requirements.

Deleting an account does not necessarily cancel an external subscription.

24. GDPR / EU / EEA

If you are located in the EU/EEA and GDPR applies to our processing of your personal information, you may exercise the rights granted under the GDPR.

You may also lodge a complaint with the data-protection authority competent for your location.

Where personal information is transferred outside the EEA, appropriate safeguards will be used where required by applicable law, which may include adequacy decisions, Standard Contractual Clauses or other lawful mechanisms.

25. INTERNATIONAL PROCESSING

Because Type Keeper may rely on global infrastructure and third-party providers, information may be processed in countries other than your country of residence.

Where applicable data-protection law imposes requirements for international transfers, we will seek to use legally recognized safeguards.

26. CHILDREN'S PRIVACY

Type Keeper is not intended for children below the minimum age permitted under applicable law.

We do not knowingly collect personal information from children in circumstances where such collection is prohibited.

If we become aware that personal information has been collected unlawfully from a child, we will take reasonable steps to delete it.

27. SECURITY

We use reasonable technical and organizational measures designed to protect information under our control.

However:

No software, device, network, Internet transmission or electronic storage system can be guaranteed to be completely secure.

Accordingly, we cannot guarantee absolute security.

In particular, we cannot guarantee protection against:

• malware;

• compromised operating systems;

• rooted or jailbroken devices;

• malicious third-party applications;

• browser vulnerabilities;

• unauthorized physical access;

• stolen devices;

• compromised accounts;

• vulnerabilities in third-party services;

• events outside our reasonable control.

28. USER RESPONSIBILITY

You remain responsible for:

• the information you choose to store using Type Keeper;

• determining whether Type Keeper is appropriate for your use case;

• maintaining your device security;

• maintaining backups where appropriate;

• protecting your accounts;

• complying with applicable law;

• ensuring that your use of the Service does not infringe another person's rights.

Type Keeper is a convenience and productivity utility and should not be treated as a guaranteed secure archive, password manager, backup system or professional data-security solution.

29. PROHIBITED USE

You may use Type Keeper only for lawful purposes.

You must not:

1. use the Service on a device or account you are not legally authorized to use;

2. violate applicable laws or regulations;

3. use the Service to facilitate fraud or criminal activity;

4. infringe another person's intellectual-property, privacy or other rights;

5. use the Service to threaten, stalk, harass, abuse or defame others;

6. interfere with the Service or its infrastructure;

7. attempt to bypass technical restrictions;

8. distribute malware through or in connection with the Service;

9. reverse engineer or decompile the Service except where applicable law expressly permits it;

10. circumvent licensing, payment or access controls;

11. use unauthorized modified or pirated versions;

12. use the Service in a way that could reasonably cause material harm to the Service, its users or its infrastructure.

30. USER CONTENT

You retain ownership of content that belongs to you.

Nothing in these Agreements transfers ownership of your personal text, clipboard content or other User Data to the Developer.

You are responsible for ensuring that you have the necessary rights to use information that you process through Type Keeper.

Because Type Keeper is designed to retain information locally, you are also responsible for managing and deleting locally stored information when appropriate.

31. INTELLECTUAL PROPERTY

The Service, including its software, source code, object code, architecture, interface, design, graphics, branding, logos, documentation and original content, is owned by or licensed to the Developer and is protected by applicable intellectual-property laws.

Except for the limited license granted to you under these Agreements, no ownership rights are transferred.

You may not:

• copy the Service;

• redistribute it;

• sell or rent it;

• sublicense it;

• reproduce substantial portions of it;

• republish proprietary materials;

• remove proprietary notices;

• create derivative works except where expressly permitted by law.

All rights not expressly granted are reserved.

32. LIMITED LICENSE

Subject to your compliance with these Agreements, you receive a limited, personal, non-exclusive, non-transferable and revocable license to use Type Keeper for its intended purposes.

The license automatically terminates if you materially violate these Agreements.

33. THIRD-PARTY SOFTWARE AND SERVICES

Type Keeper may depend upon software, libraries, SDKs, operating-system functionality and services provided by third parties.

Those third parties may have their own:

• terms of service;

• privacy policies;

• licenses;

• billing rules; and

• service availability requirements.

We are not responsible for independent failures or changes made by third-party providers.

34. APP STORES AND PLATFORM PROVIDERS

Type Keeper may be distributed through Google Play, Chrome Web Store or other authorized platforms.

Your use of such platforms is also subject to their respective terms.

Platform operators may have rights as third-party beneficiaries where required by their applicable developer agreements.

The platform operator is not responsible for providing the Service itself unless expressly required by its applicable terms.

35. SERVICE AVAILABILITY

We aim to keep Type Keeper functional and available, but we do not guarantee uninterrupted availability.

The Service may become temporarily unavailable because of:

• maintenance;

• software updates;

• operating-system changes;

• browser changes;

• third-party outages;

• network failures;

• security incidents;

• technical failures;

• force majeure;

• circumstances beyond our reasonable control.

36. UPDATES AND CHANGES

We may release updates, patches, upgrades, security fixes, bug fixes or new versions.

Some updates may be necessary to maintain compatibility or security.

We may modify, add or remove functionality.

Where a feature depends on a third-party platform, that feature may change or cease to function if the third party changes its platform or policies.

37. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF:

• MERCHANTABILITY;

• FITNESS FOR A PARTICULAR PURPOSE;

• NON-INFRINGEMENT;

• AVAILABILITY;

• ACCURACY;

• RELIABILITY;

• SECURITY; AND

• UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT:

1. THE SERVICE WILL ALWAYS BE AVAILABLE;

2. THE SERVICE WILL BE ERROR-FREE;

3. ALL DEFECTS WILL BE CORRECTED;

4. DATA WILL NEVER BE LOST OR CORRUPTED;

5. THE SERVICE WILL WORK WITH EVERY DEVICE, BROWSER OR OPERATING SYSTEM;

6. THE SERVICE WILL PROVIDE COMPLETE PROTECTION AGAINST DATA LOSS OR SECURITY THREATS;

7. INFORMATION PROVIDED BY THE SERVICE WILL ALWAYS BE COMPLETE, CURRENT OR ACCURATE.

Nothing in this section excludes warranties that cannot legally be excluded.

38. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER AND ITS LICENSORS, CONTRACTORS, SERVICE PROVIDERS AND CONTRIBUTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING:

• LOSS OF DATA;

• LOSS OF PROFITS;

• LOSS OF REVENUE;

• LOSS OF BUSINESS;

• LOSS OF GOODWILL;

• LOSS OF USE;

• DEVICE DAMAGE;

• DATA CORRUPTION;

• SECURITY INCIDENTS;

• INTERRUPTION OF SERVICE.

This limitation applies regardless of the legal theory on which a claim is based, including contract, negligence, tort, warranty or otherwise.

To the maximum extent permitted by applicable law, the aggregate liability of the Developer arising from or relating to the Service shall not exceed the greater of:

(a) the total amount actually paid by you for Type Keeper during the twelve (12) months immediately preceding the event giving rise to the claim;

(b) EUR 100.

Nothing in these Agreements excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, intentional misconduct or mandatory consumer-protection law.

39. DATA LOSS DISCLAIMER

Type Keeper may retain information locally on your device.

You acknowledge that locally stored information may be lost as a result of:

• device failure;

• application deletion;

• operating-system updates;

• device reset;

• malware;

• unauthorized access;

• storage failure;

• browser data deletion;

• user action;

• circumstances outside our control.

Type Keeper is not a substitute for an independent backup system.

You are responsible for maintaining backups of information that you cannot afford to lose.

40. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless the Developer and its affiliates, licensors, contractors and service providers from claims, damages, liabilities, losses and reasonable costs arising from:

• your violation of these Agreements;

• your unlawful use of the Service;

• your infringement of another person's rights;

• your User Data;

• your violation of applicable law.

This obligation does not apply to the extent a claim results from conduct for which the Developer is legally responsible.

41. SUSPENSION AND TERMINATION

You may stop using Type Keeper at any time.

We may suspend or terminate access to certain functionality where reasonably necessary because of:

• material violation of these Agreements;

• fraud;

• abuse;

• security concerns;

• unlawful activity;

• payment-related issues;

• technical necessity;

• legal requirements.

Termination does not affect provisions which by their nature should survive termination, including intellectual-property provisions, disclaimers, limitations of liability and indemnification.

42. CHANGES TO THESE AGREEMENTS

We may update these Agreements from time to time.

The latest version will be published on the Type Keeper website with an updated Last Updated date.

For material changes, we may provide additional notice through the Service or another reasonable method where appropriate.

Your continued use of Type Keeper after an updated version becomes effective constitutes acceptance of the updated Agreements to the extent permitted by applicable law.

If you do not agree to a material update, you must stop using the Service.

43. SEVERABILITY

If any provision of these Agreements is determined to be invalid, unlawful or unenforceable, that provision will be enforced to the maximum extent legally permissible and the remaining provisions will remain in full force and effect.

44. NO WAIVER

Failure to enforce any provision of these Agreements does not constitute a waiver of that provision or any other right.

45. ENTIRE AGREEMENT

These Agreements constitute the complete agreement between you and the Developer concerning your use of Type Keeper and supersede prior versions concerning the same subject matter, except where otherwise required by law.

46. GOVERNING LAW AND DISPUTES

These Agreements shall be governed by applicable law, without prejudice to mandatory consumer-protection rights applicable to you.

If you are an EU/EEA consumer, nothing in these Agreements removes mandatory rights or jurisdiction granted to you by applicable consumer law.

Where legally permissible, disputes may be submitted to the competent courts having jurisdiction over the Developer.

Nothing prevents a consumer from exercising mandatory rights before the courts or authorities available under applicable consumer-protection law.

48. IMPORTANT PRIVACY NOTICE

For clarity, the most important privacy principles of Type Keeper are:

• Type Keeper is not a password manager.

• Type Keeper is designed not to retain password-field contents.

• Core text and clipboard functionality is designed primarily around local processing and local storage.

• We do not intentionally collct or sell your private Type Keeper text input or clipboard history.

• Third-party services may process limited technical, diagnostic, advertising, account or payment information.

• Local data security depends partly on the security of your own device.

• Rooted, jailbroken, compromised or maliciously modified devices may expose locally stored information.

• No electronic system can be guaranteed to be absolutely secure.

• You can request access to applicable personal information.

• You can request account deletion by contacting typekeeper@gmail.com.

• Mandatory privacy and consumer rights remain unaffected by these Agreements.

By installing, accessing or using Type Keeper, you acknowledge that you have read and understood these Terms of Service & Privacy Policy and agree to be bound by them to the extent permitted by applicable law.

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE. IN NO EVENT SHALL THE COPYRIGHT HOLDERS OR ANYONE DISTRIBUTING THE SOFTWARE BE LIABLE FOR ANY DAMAGES OR OTHER LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
